In a Chapter 7 bankruptcy filing, you have the opportunity to discharge certain debts in exchange for the sale or liquidation of some of your assets. Under the new bankruptcy law, enacted in 2005, you must now qualify to file for protection under Chapter 7 by submitting to a "means test." The bankruptcy court uses the means test to determine whether you have the earning capacity to repay your creditors.
If the court determines that you have the ability to pay your creditors back, your only recourse in bankruptcy will be under Chapter 13. In a Chapter 13, known as reorganization, you agree to new terms with all of your creditors. Your debt is only discharged when you have made all payments under the reorganization plan.

In a Chapter 13 bankruptcy, we will review any proposed repayment plans to make certain they are within your means. If you make an agreement to repay creditors, but fail to keep the terms of the agreement, you can lose all the protections offered by the bankruptcy laws.
