Using ABLE Accounts in Special Needs Planning

The ABLE (Achieving a Better Life Experience) Act is a federal law that lets states establish tax-advantaged savings programs for people with disabilities. The program is modeled after 529 education savings accounts.

ABLE accounts complement — they don't replace — a properly drafted third-party special needs trust. Together, the two tools let a family plan for a loved one with a disability without disqualifying them from means-tested benefits.
