What is Included in a Complete Estate Plan?

When most people think about estate planning, they picture a simple will and not much else. We hear this a lot at Johnson Law LLC, and it is one of the biggest misconceptions we run into. A complete estate plan is made up of several documents that work together, and each one protects you and your family in a different way. 

It Starts With More Than Just a Will

A will is an important piece of the puzzle, but it only takes effect after you pass away. It says nothing about who manages your finances or makes medical decisions for you if you become incapacitated. That is why we always tell our clients that a will by itself is not really a plan. A true estate plan addresses both end-of-life wishes and the years leading up to it.

In Maryland, wills are governed under the Estates and Trusts Article, which sets out specific requirements for a will to be considered valid. We make sure every will we draft meets those requirements so it holds up when it matters most. Beyond that, we look at the whole picture of your life and your family before deciding what other documents you need.

Powers of Attorney Protect You While You are Still Here

A financial power of attorney lets someone you trust step in and handle your bills, accounts, and property if you are unable to do it yourself. Without one, your family may need to go to court just to get that authority, even for a short-term illness or injury. We see how stressful that becomes for families, and it is almost always avoidable with proper planning in advance.

An advance medical directive works the same way for health care decisions. It names someone to speak for you and outlines your treatment wishes if you cannot communicate them yourself. Maryland's Health Care Decisions Act gives this document real legal weight, and the Maryland Courts' self-help resources offer general background information. However, we make sure yours reflects what you actually want, not a generic template.

Trusts Can Round Out the Picture

Depending on your goals, a revocable living trust may also be part of your plan. Trusts can help your family avoid the probate process entirely, keep your affairs private, and provide more control over how and when your beneficiaries receive their inheritance. We often recommend this through our estate and trust administration services, especially for clients with real estate, blended families, or beneficiaries who need extra protection.
